涉外民事诉讼：人在国外、境外，如何委托中国律师参与国内的诉讼

The principal further appoint and empower each of the above listed Attorneys: to prepare, sign and submit the statements of complaints on behalf of the Principal for the Case; to file the complaint with the court and to pay the court fees; to appear before the competent court hearings; to present defense opinions against counter-claims; to make defense; to present defense opinions against the jurisdictional contestation and attend the hearing or similar court procedure for this jurisdictional contestation; to file the appeal against the decision made by court on the jurisdictional contestation and attend related appeal procedure; to investigate, collect and deliver to the court tribunal any evidence; to apply for the court investigation and/or apply for the court investigation writ; to undertake notarization; to procure the relevant documents from competent authorities; to apply for any extension of time deadlines; to apply for addition of defendants and/or interested third parties; to prepare and sign the statements of appeal/re-trial and file an appeal/re-trials; to make compromises and/or accept any mediation presided over by the court tribunal; to submit attorney’s opinions; to admit, waive or modify the claims; to withdraw the Case; to apply for judicial appraisal; to apply to relevant courts for measures of property preservation ,evidence preservation, injunction order (including without limitation signing the application for relevant preservation and submitting related documents); to apply for reconsideration in respect of the preservation verdict; to undertake the formalities for the renewal or cancellation of the preservation/preservation measures; to apply to relevant courts for enforcement of the judgment, mediation paper or other valid legal instrument(including without limitation signing the application for enforcement, filing the application for enforcement, participating in the enforcement procedure) ; to attend the court procedure for any contestation against the enforcement; to sign and receive any judicial document/legal instrument served by the court; to receive relevant payment (including without limitation, court fee, settlement amount, enforcement amount, compensation amount) and to handle all other matters in connection with the Case.

上述任一位代理人的权限为：特别授权代理，包括但不限于：代为撰写、签署和提交起诉状；代为立案及代为缴纳诉讼费；代为出庭；代为答辩；代为针对反诉答辩；代为针对管辖权异议答辩、参加管辖权异议的听证程序或相关法院程序；代为就法院针对管辖权异议作出的裁定提出上诉并参加该管辖权异议上诉程序；代为调查取证，收集和提交证据；代为申请法院调查取证及/或申请调查令；代为办理公证；代为向相关部门调取相关文件；代为提出延期申请；代为申请追加被告和/或第三人；代为撰写和签署上诉状/再审申请书，代为提起上诉/再审；代为同意和接受法庭调解、庭外和解；提交代理意见；代为承认、放弃或者变更诉讼请求；代为申请撤诉；代为申请鉴定；代为向相关法院申请财产保全、证据保全、行为保全（包括但不限于代为签署相关保全申请书、提交保全所需材料等）；代为就保全裁定申请复议；代为办理保全及保全措施的续保或解除手续；代为向相关法院申请强制执行判决、调解书以及其他生效法律文书（包括但不限于代为签署执行申请书、代为办理执行立案手续、参加执行程序）；代为参加执行异议程序；代为签收法院文书以及其他法律文书；代为收取相关款项（包括但不限于诉讼费、和解款项、执行款项和赔偿款项）以及代为处理其他与案件有关的一切事宜。

Any Attorney listed above may delegate his/her power hereunder to another attorney of the firm by a written letter of authorization.

上述任何一位代理人均有权以书面授权的方式将其在本授权委托书项下的权限转授予其所在律所的任何另外一位律师。

The principal further grants her recognition to the acts made and the documents signed by the Attorney mentioned above within the limits of the powers granted herein.

代理人在上述权限范围内所作出的行为及签署的一切有关文书，委托人均予以承认。

The principal hereby confirms that this Power of Attorney shall be effective from the date of execution hereof and remain in full force till the completion of the matters as set forth in this Power of Attorney.

兹确认，委托人出具此授权委托书，其有效期自本授权委托书签署之日起至上述委托事项完毕止。
